This seminar addresses how to recognize the warning signs of a difficult customer at the out set, how to avoid claims for deceptive advertising, how to control and manage a difficult customer during the formative stages of the project which include drawings, specs and the contract, how to cover yourself during the course of the project with the appropriate project documentation such as change orders, meeting minutes, emails, etc., how to structure your business to protect yourself from the litigious customer, how to firmly manage the project (and your customer) in terms of scheduling, decision-making, progress payments, product selections, etc, and (finally) how to show the love during the warranty period. The seminar comes complete with coursebook written by the speaker.

You will learn how to set up your business as either as a corporation or a limited liability company, and you will learn how to properly operate your business in order to maintain separateness between your personal assets and your business liabilities. Employee Manuals, Non-Competition Agreements, Non-Disclosure Agreements and Non-Solicitation Agreements are reviewed as are jobsite postings which are required by WISHA and L&I.

Bidding mistakes and bid withdrawals are also covered at the seminar and how to handle the general contractor's subcontract. You will learn how to properly respond in an inoffensive manner to the general contractor with regard to signing and returning the general contractors proposed subcontract. You will also learn how to prepare your own contract for those situations where you are dealing directly with an owner or you have the opportunity to submit your own contract to a general contractor.

Finally, you will learn how to submit claims for extensions of time and additional compensation based upon delay, acceleration or differing site conditions.

The Washington State Department of Labor and Industries presents the following seminars which are offered to recently registered contractors who are participating in the orientation program offered by the Washington State Department of Labor and Industries. Two seminars are currently offered for L&I attendees. The Construction Contracts seminar is designed to educate contractors on which contract clauses are essential to include in their construction agreements. The seminar focuses on preparation of contracts for a contractor that reduce costs when litigation occurs as well as addressing other critical issues such as warranty, correction of work, punch list items, allowances and required lien notices. The Protecting Your Assets seminar is designed to educate contractors on which entity they should consider forming or reforming. Materials cover the pros and cons of the three main business forms: sole proprietors, LLCs, and corporations, as well as noncompetition agreements, nondisclosure agreements, trade names and trademarks.
